AUTHOR-PUBLISHER AGREEMENT
Effective from the Date of Payment

This Agreement is made between you (referred to as “You” or the “Author”) and Smart Moves Publication, Bhopal, Madhya Pradesh, India (referred to as “Smart Moves”).

This Agreement becomes effective on the date the Author or an authorized representative makes the payment towards the publication of the manuscript/book attached to this Agreement (hereinafter referred to as the “Effective Date”).

SMART MOVES is a registered sole proprietorship in the state of Madhya Pradesh, India. Established in 2012, it is a for-profit publishing house owned and operated by Mr. Rajeev Tiwari. The organization publishes academic journals and books in both digital and print formats.

1. Agreement Acceptance

By submitting your manuscript/book and making the publication fee payment, you are deemed to have fully accepted all the publication terms and policies outlined by Smart Moves, as listed on its official website. This acceptance is considered valid and binding for all legal and procedural matters.

Upon manuscript submission, Smart Moves will also share the relevant publication policy links with the author for reference and compliance.

By submitting a research paper or book to Smart Moves, both the Author and Smart Moves agree to abide by the terms outlined in this Agreement. If the Author does not accept the publication policies or Agreement, Smart Moves reserves the right to decline publication.

By paying the publication fee, the Author affirms that:

  • Theyhave read, understood, and agreed to all terms and policies of Smart Moves.
  • They acceptfull responsibility for any conflict, legal claim, or issue arising from the submitted content.
  • The submitted workdoes not contain plagiarized content, copyrighted material without permission, falsified data, or hateful or defamatory content.

2. Services Offered

Smart Moves offers the following services under this Agreement:

  • Publication of Manuscripts(e.g., academic articles or research papers in journals)
  • Publication of Books
  • Editing and proofreading
  • Cover and interior designing
  • ISBN assignment
  • Copyright registration
  • Printing and eBook creation
  • Marketing and distribution (including online platforms)

3. Print Copy Dispatch Policy

  • Authors must provide a complete postal address with PIN code and mobile number.
  • Dispatch of print copies is made within60–70 working days, and tracking details are emailed.
  • Courier preference may be considered at the author’s cost.
  • Claims for non-delivery must be raised within 7 business days of dispatch notification.
  • Smart Moves isnot liable for delivery failures due to incorrect/incomplete addresses or contact details. In such cases, re-dispatch costs will be borne by the author.

4. Author’s Responsibility

You accept full responsibility for the originality, legality, and integrity of the content. Smart Moves does not endorse or validate any views expressed. You confirm that:

  • The content is not plagiarized or unlawful.
  • The work does not harm or defame any person, group, or community.
  • All real-life references are either fictitious or used with consent.
  • You shall bear all legal liability for copyright claims, defamation, or any third-party infringement.

5. Authors’ Rights and Duties

  • Initial Obligation: Submit the manuscript in MS Word format.
  • Information: Provide all necessary publishing details.
  • ISBN Restriction: ISBN issued by Smart Moves isnon-transferable.
  • You may not use the same ISBN or design for publishing with another publisher.

6. Payment

Smart Moves shall begin work only after full payment of the selected Package Fee by the Author or an authorized representative.

7. Royalties

Print Book Sales:

  • You (Author):75%
  • Smart Moves:25%
    (Net amount after distribution, returns, taxes, etc.)

E-Book Sales:

  • You (Author):75%
  • Smart Moves:25%
    (Net amount after distribution mark-ups, taxes, etc.)

Royalties are not applicable for free or self-purchased copies.

8. Royalty Payment Timing

  • Calculated monthly, paid within30 days after month-end.
  • Minimum threshold for payout:USD 100 (cumulative).
  • If unpaid for a calendar year, royalty will be paid byJanuary 30.
  • Bank charges/taxeson transfers will be borne by the Author.
  • Payments viaNEFT/RTGS/PayPal/Swift as applicable.

9. Refunds

No refund will be provided if the manuscript is not submitted within 30 days of payment. The agreement will then be deemed terminated.

10. Tax Withholding

  • Author must provide required tax documentation (e.g., PAN or TIN).
  • Smart Moves may withhold royalty until compliance.
  • Withheld amounts will be paidwithin 7 working days of receiving documents.

11. Pricing Policy

Smart Moves reserves the right to set the book’s price based on market dynamics, distribution costs, and associated expenses.

12. Licensing & Intellectual Property

  • You grant Smart Movesnon-exclusive, irrevocable worldwide rights to publish, distribute, and promote your work.
  • Copyright remainswith the Author.
  • Smart Moves may reproduce, index, reformat, convert, encode, and store the content for operational needs.

13. Format, ISBN, and Hosting

  • Smart Moves may assign multiple ISBNs for different versions.
  • The publisher may retain submitted files and metadata for record and sales analytics.
  • Smart Moves is authorized to store, host, and promote the book electronically.

14. Publicity and Marketing

You grant Smart Moves the rights to:

  • Use your name, bio, image, and excerpts for promotional purposes.
  • Providefree review copies to media or academic outlets.
  • Offer promotional services of equal or greater value if needed.

15. Content Security

Smart Moves ensures confidential handling of your manuscript and materials before, during, and after publication.

16. Timeline

Work on formatting and printing starts after final manuscript approval and receipt of full payment. Delays due to late responses from the Author are excluded from timeline estimates.

17. Copyright & Title Registration

Smart Moves will include your specified copyright notice and assist with title registration as part of the process.

18. Term & Termination

  • This Agreement remains in force unlessterminated by Smart Moves, at its sole discretion, without obligation to provide cause.
  • All outstanding royalties will be settled post-termination.
  • Pending customer orders will be fulfilled even after termination.

19. Disclaimers

  • Smart Moves doesnot guarantee book sales, media coverage, or commercial success.
  • Smart Moves isnot liable for errors or delays caused by third-party vendors, distributors, or partners.

20. Limitation of Liability

Smart Moves’ liability is limited to the amount paid by you under this Agreement. No consequential, indirect, or punitive damages shall be claimed.

21. Indemnification

You agree to indemnify and hold Smart Moves harmless against any third-party legal claims arising out of breach of this Agreement or infringement of rights.

  • All communications will be sent to yourregistered email ID.

23. Assignment

You may not assign or transfer this Agreement. Smart Moves may delegate its duties or assign rights to affiliated entities.

24. Force Majeure

Neither party is liable for non-performance caused by events beyond reasonable control (natural calamities, war, technical failures, etc.).

24. Legal Jurisdiction & Arbitration

  • Jurisdiction:Courts of Bhopal (M.P.), India
  • Dispute Resolution:Arbitrator appointed by Smart Moves, conducted in English under the Arbitration & Conciliation Act, 1996.
  • Place of Arbitration:Bhopal, MP, India
